Christopher J. Merken

Christopher prosecutes and defends matters involving trade secret misappropriation, covenants not to compete, non-disclosure agreements, breaches of fiduciary duties, and unfair competition claims. He handles emergency injunctive relief applications and has litigated these claims through trial and arbitration (AAA, FINRA, JAMS). He defends employers in discrimination, harassment, and retaliation litigation under federal and state law, representing them before the EEOC, courts, and arbitration forums.

Christopher has developed a robust financial services practice representing fintech companies, hedge funds, and money managers in employment disputes, restrictive covenant enforcement, trade secrets protection, and commercial litigation.

In 2023, Christopher served as trial counsel securing a $108 million judgment for a financial services firm. In 2024, he won a rare corporate director dispute victory and secured a complete victory in a racial gerrymandering trial. In 2025, he helped secure a unanimous Supreme Court victory providing guidance on final-judgment relief. He has contributed to nearly a dozen Supreme Court briefs and represented clients in complex appellate matters.

Before joining Fisher Phillips, Christopher clerked for Judge Jane R. Roth on the Third Circuit and Judge Madeline H. Haikala of the Northern District of Alabama.
