On May 13, 2016, the federal government published a guidance document that reaffirmed its 2015 opinion letter on how Title IX’s regulations apply to transgender students. This guidance summarizes best practices on how to handle student transition, privacy, confidentiality, student records, sex-segregated activities and facilities, and various support issues. Although it is limited to K-12 schools, it is critical for all educational institutions that receive federal funding (colleges and universities included) to understand and comply with the guidance as soon as practicable.
