In November 2019 the US Department of Labor announced a proposed change to the Fair Labor Standards Act’s fluctuating workweek method of compensation. In an article for Law360, Sarabeth Hall explores the proposed rule’s shortcomings including its failure to address the heavily litigated fluctuating hours requirement. Hall reminds employers that, as of right now, it’s merely proposed language and “employers should refrain from enacting changes in their pay plans and related compensation mechanisms if based upon the proposed rule only.”
