A bevy of legal and compliance issues continue to bedevil higher education administrators throughout the country, including Texas. Please join Fisher Phillips for a Texas-centered, exclusive seminar which addresses those issues and focuses on a practical and cost effective approaches to compliance and to preserving an institution’s trust and reputation.

Recent Developments in Title IX Compliance Reviews and Related Title IX and Student Conduct Litigation with a Particular Emphasis on Texas
Each region of the Department of Education Office of Civil Rights is in the midst of Title IX compliance reviews. This segment of the program will focus on national developments with these compliance reviews but will also provide information on the determinations made by your particular regional office so that you can go back to your campus and meaningfully assess how your institution would fare in a compliance review and make appropriate changes.
Similarly, litigation in this area is exploding both from victims of sexual assault who are filing Title IX claims against institutions and students who are disciplined by schools after being found responsible for engaging in sexual misconduct. This segment will provide you with a review of the case law in Texas with a particular emphasis on court decisions dealing with Title IX, due process and breach of contract challenges to discipline, and fundamental fairness claims. It will also provide practical risk management tips to position your college or university for success in the event you end up in similar litigation.
Understanding Section 504 and the ADA and Common Issues Faced in Higher Education
Today, there are more students with documented disabilities in higher education than ever before and faculty and staff disability issues often present exceptionally complicated human resources questions. This segment will briefly review institutional requirements under Section 504 and the ADA as well as federal and Texas case law. It will also offer practical guidance on responding to disability concerns in a variety of different contexts, including admissions, the extent of accommodations which must be provided, and the circumstances in which termination may be warranted.
What’s Hot in Higher Education Legal Compliance?
Finally, this segment will discussion recent hot topics in higher education including institutional obligations to transgendered students, the status of affirmative action, a renewed focus on sex harassment prevention among faculty, etc.
