In an interview with the San Francisco Chronicle, Hannah Sweiss discusses the hot topic of Bay Area businesses requiring their employees to get vaccinated against the coronavirus. The article explains that employers can legally mandate the vaccine, and, according to federal and state guidance, employers can ask employees about their vaccination status. But Hannah warns that there are privacy risks, and even though employers can ask employees about their vaccination status they cannot dig any deeper. She also explains that there is not a broadly accepted standard of what constitutes a vaccination record and is quick to remind employers that “the act of requesting and storing employee medical records carries with it significant privacy obligations for a company.”
