Sacramento Partner Discusses Latest Cal/OSHA Workplace Standards

In an interview with the Daily Journal, Ben Ebbink explains what employers need to know about Cal/OSHA’s latest updates to its COVID-19 workplace standards. While the new rules are less burdensome for employers to follow, compliance for most of them hinge on a critical piece of information: Which of their workers are vaccinated? Ben says that one potential solution to avoid running afoul of laws like the ADA and the state Confidentiality of Medical Information Act is to require all employees to get vaccinated. However, that approach comes with a separate set of issues. Ultimately, he says, employers must weigh costs and benefits related to requiring or encouraging their workforce to get vaccinated.
