Sacramento Attorney Examines Re-Introduced California #MeToo Bills

In his bylined piece for The Recorder titled “Déjà Vu All Over Again? Pair of Vetoed #MeToo Proposals Re-Introduced in the California Legislature,” Sacramento Of Counsel Benjamin M. Ebbink discusses California Assembly Bills 170 and 171, two #MeToo-inspired bills that have been reintroduced in the legislature after being vetoed by Gov. Jerry Brown in 2018.
Regarding AB 170, Ben says employers are concerned about statutes that establish joint liability for situations where the employer may not have requisite control. According to Ben, employers are similarly concerned about AB 171, which would shift the burden of proving retaliation. Ben indicates that Governor Newsom has not yet taken a position on either bill and it remains to be seen whether either has a better shot at being signed into law in 2019.
