Sacramento Attorney Comments on California OSHA AB 2334

In a reaction to the Trump Administration’s efforts to change OSHA record-keeping mandates, California Gov. Jerry Brown signed Assembly Bill 2334 to be effective Jan.1, 2019. The bill will allow the California Division of Occupational Safety and Health to cite employers for recordkeeping violations that are up to five years old. Currently, under the Trump Administration, the state and federal limit is six months. Sacramento attorney Benjamin Ebbink told Bloomberg Law that “California is paying close attention to the changes the Trump administration makes to OSHA. It remains to be seen whether Cal/OSHA will interpret the law to be retroactive or applicable to the record-keeping issue after Jan. 1.”
