Philadelphia Partner Discusses the Path of the FTC’s Proposed Ban on Non-competes

In an interview with HR Dive, Dave Walton shares his insights on the FTC’s proposed rule banning non-competes and notes that “there are not a lot of situations where you see a pure noncompete anymore.” He explains that the proposed federal rule follows a significant trend at the state level toward limiting the types of employees who may be asked to sign non-competes and other restrictive covenant agreements. Dave urges employers to take a hard look at their nonsolicitation agreements to ensure that they cannot be construed as non-competes.
