Philadelphia Attorney Comments on the Fight For Equal Pay

Lori Armstrong Halber of the Philadelphia office was interviewed on the NBC television station NBC 10 in Philadelphia. In this interview, she provides background on the gender wage gap, navigating wage laws for companies located in multiple jurisdictions and explains why Philadelphia’s ordinance to eliminate the wage gap was partially blocked.

The Philadelphia ordinance for eliminating the pay gap has two components, the first one prohibits inquiring about salary history and the second prohibits relying on that information to determine an employee’s salary. The Chamber of Commerce challenged this ordinance and a federal judge ruled that the first component violates the First Amendment. In the hiring process, inquiring about salary history is seen as commercial speech and can only be regulated under certain circumstances. The judge ultimately found this regulation doesn’t support solving pay disparity.
