Partner Discusses Whether Employers Can Make Unvaccinated Workers Pay for COVID Tests

In an interview with McClatchy, Travis Vance discusses the thorny issue of who pays for expenses related to the federal vaccine mandate. He explains that while testing for unvaccinated workers may be a cost that is absorbed by the employee, there are some exceptions. Travis advises that some states like California, Illinois and Kentucky bar employers from passing the cost of medical testing on to their employees. He also adds that there are regulations associated with the Fair Labor Standards Act and the Equal Employment Opportunity Commission under which employers cannot ask their workers to pay for regular COVID tests “if it causes their pay to fall below the minimum wage.”
