As the U.S. Immigration and Customs Enforcement (ICE) increases its efforts to eliminate illegal immigration, employers seek to help their employees, as well as comply with immigration law. In the HR Executive article “ICE Ramps Up Employer Audits,” Memphis Managing Partner David Jones explains that he has seen in an increase of employers wanting to help their undocumented employees avoid deportation and remain working.
David said, “Depending on the employee’s situation, it may be possible for the employer to help that person get status, but that is going to be completely on a case-by-case basis.”
Once you begin seeking legal counsel, David informs employers that they can no longer employ an undocumented worker while trying to help them with their status.
