On Duty Meal and Rest Breaks: Coping With the Reality of “On-Duty,” All the Time

Event

8.17.17

This webinar will provide attendees with the practical guidance necessary to address the emerging case law undermining the ability of California employers to manage employee breaks.  In Augustus, et al. v. ABM Security Services, Inc, the California Supreme Court reversed the 2nd District Court of Appeal, concluding that, “state law prohibits on-duty and on-call rest periods.” This decision, coupled with prior rulings regarding employee meal periods, has created an environment in which employers have great difficulty complying with the Labor Code.  This is especially the case for employers in the transportation industry, where drivers are required to attend vehicles at all times.

By providing a brief background of the state of the law and detailing the best practices to address these difficulties, we hope to empower employers to manage their workforce while minimizing liability.
