As social media use continues to rise at an exponential rate, employers are increasingly finding themselves in the difficult position of needing to regulate their employees’ non-workplace speech in order to prevent significant damage to themselves and others. Fortunately, recent decisions by California courts and the National Labor Relations Board have provided new guidance on the issue of what actions employers can and cannot take in response to potentially troublesome statements made by employees using their personal social media accounts.
