New York Partner Discusses Vaccine Mandates and Incentives in the Workplace

In an interview with Newsday, Seth Kaufman explains how far employers can go to mandate or encourage their employees to get vaccinated against COVID-19. Recent EEOC guidance leaves room for interpretation and discretion, especially when employee objections are based on religion or an individual’s disability and whether employers can offer incentives. Seth explains that the EEOC’s guidance doesn’t address any limits on incentives for vaccinations received outside of their employer, nor does it lay out parameters on what size incentive might be considered coercive. He encourages employers to use “common sense” when rolling our incentives for vaccinations.
