Alvaro Hasani was quoted in Law360 on December 24, 2015. The article “New York Cases To Watch In 2016” provided a rundown of significant cases to watch in 2016, including the upcoming U.S. Supreme Court case Friedrichs v. California Teacher’s Association that could deal a devastating blow to public-sector unions in New York.
Alvaro, said if the Supreme Court sides with the petitioning teachers, New York could feel outsized effects.
“I think it would have a definite significant impact in New York. There are a lot of union jobs in the state and the city,” he said. “New York is right up there with California."
While New York has a state law, the Public Employees Fair Employment Act, also known as the Taylor Law, which provides for the payment of agency shop fees by nonunion public employees, depending how the High Court rules, that might not be enough, according to Alvaro.
“My suspicion is that if the Supreme Court rules in favor of the plaintiffs, the Taylor Law is going to be in jeopardy,” he said.
