In a December 2019 announcement, U.S. Citizenship and Immigration Services (USCIS) revealed that employers seeking to file H-1B cap-subject petitions for Fiscal Year 2021’s season – which will run from March 1 to March 20, 2020 – will be required to electronically register and pay a registration fee. The electronic registration system is intended to simplify the annual process, reduce paperwork and streamline the exchange of data. The switch to online electronic registration is not the only change – in working to streamline the process, USCIS has implemented numerous other changes to the H-1B cap lottery process of which employers need to be aware. As is the case with most new systems, employers and applicants have many questions and areas of concern.
