Mixed Prospects for POWADA

Atlanta attorney Ted Boehm was interviewed in the August 15 article “Mixed Prospects for POWADA” on Human Resource Executive Online.

The article reported that The Protecting Older Workers Against Discrimination Act, a bill originally introduced in 2009, has recently been brought back into the spotlight after a strong endorsement from the AARP and a recent Supreme Court decision in an age discrimination case.

Ted noted that the bill’s chances of becoming law in 2013 are “mixed at best.”

He said that the biggest impact this type of law would have is in litigation. It would lower the burden of proof for plaintiffs. 

He said that HR leaders would need "to be more certain that personnel decisions are not made on the basis of age" in order to avoid potential age discrimination claims.
