“The one bright spot is the incoming administration, which should make many changes to the regulations that were passed by executive order and agency action under the prior administration,” Thompson said.

“If the 5th Circuit upholds the ruling, this [overtime] provision is dead in the water,” Martin Thompson said. “However, if the ruling is reversed, the question is when will the law go into effect: immediately, retroactively or prospectively.”
