Denver partner Danielle Urban was quoted in the June 3 Bloomberg.com article "Marijuana for Migraines Tests Sprint Policy on Workplace Drugs." The article cited a recent case where a 21 year old woman sued her employer for firing her after she failed a company required drug test. The woman claimed that her healthcare provider prescribed the marijuana for relief of migraine headaches. The outcome of the case, now before the state's Supreme Court, may guide U.S. employers caught between their efforts to maintain a drug-free workplace and laws in 16 states and the District of Columbia that permit the use of marijuana for medical purposes. Danielle said: "Employers are in a tizzy. What if an employee comes in impaired? No one wants to be sued. It could be very costly."
