Lawyer Shares Insights on OSHA Guidance Amid COVID-19 Pandemic

On April 10, 2020 the Occupational Safety and Health Administration (OSHA) released interim guidance relieving most employers of their duty to determine whether a COVID-19 case is work-related. In an interview with Law Week Colorado, Kristin White explains that OSHA’s guidance largely relies on the availability of evidence. She notes, “[t]he new guidance is making it a higher burden to record than regular injury or illness because you’ve got to have that objective evidence piece.” She goes on to explain how difficult that can be because “with the way this virus travels, there may be no way that you have any objective evidence that it came from a co-worker.”
