In an interview with SHRM, Jacqueline Del Villar weighs in on whether the Texas ban on vaccine mandates will hold up in court. Aside from the issue of whether the state order can pre-empt the federal mandate, Jacqueline says that challengers will likely argue that limiting an entity's ability to impose conditions of employment, such as vaccine mandates, goes beyond the governor’s authority. Additionally, she says that the Texas order potentially creates ambiguity around the state’s at-will employment doctrine.
