Labor Relations Co-Chair Discusses Scope of NLRB’s Remedial Powers

In an interview with Bloomberg Law, Steven Bernstein shares his insights on the scope of the National Labor Relations Board’s (NLRB’s) remedial powers before federal courts. Steve explains that while the remedies themselves are not necessarily new, the board seems to be applying them in a novel way. And the article highlights some of the remedies that have been deployed by the NLRB in recent cases, and Steve notes that employers will be watching to see how other similar cases turn out. He explains that for now, the courts will likely continue to err on the side of deference to the NLRB when it comes to remedies, but he notes that “we could be having a very different conversation in two to three months from now.”
