Kasia Nowak was interviewed by Employment Law 360 after the U.S. Supreme Court ruled that a Michigan law banning affirmative action programs for college admissions is constitutional.
She said the Supreme Court decision in Schuette v. Coalition to Defend Affirmative Action is significant for the following reasons:
- The decision opens the doors for other states to enact similar ballot initiatives.
- It requires public schools and government programs to engage in a balancing act where policies are drafted that fit within the limits prescribed by the Supreme Court, while simultaneously encouraging diversity.
- It demands a continuing dialogue as to what constitutes the current landscape of admissions and what that landscape will be (and look like) in the future.
