David Jones authored the article “International Travel Advisory for Foreign National Employees” featured in Biz Journal. In this article, David discusses the current reasons for employers to be concerned when foreign national employees are traveling abroad.
One example: The Russian government has imposed a visa issuance cap on nonimmigrant visas on the U.S. mission in Russia. The U.S. mission has started to cancel appointments for interviews. All interviews going forward will only take place in Moscow and foreign nationals can process visas in Canada or Mexico.
Traveling internationally while an I-131 application is pending will result in the denial of that application, therefore international travel is not advised. Employers should note that if travel is unavoidable, a new I-131 application will be required.
Lastly, due to “extreme vetting” procedures and travel bans to the U.S of certain nationals there are security delays. David states that employers should ensure their international employees are aware of the risk and discourage travel or have a contingency plan if their employee cannot make a timely return.
