California firmly remains a “blue” state. Governor Jerry Brown has defiantly stated, “California is not turning back. Not now, not ever.” The California Legislature has responded by introducing dozens of bills to keep pushing the envelope on labor and employment issues. From ban the box proposals to equal pay initiatives, from immigration enforcement to measures to raise the overtime exemption threshold, 2017 is shaping up to be a busy year for California employers.
At the same time, lots of changes are happening at the federal level – many of which are positive developments for employers. A newly confirmed Supreme Court justice gives the Court a decidedly conservative majority, affecting labor and employment laws at the highest level. New leadership at the Department of Labor and the National Labor Relations Board signal a more business-friendly approach and a scaling-back of some of the Obama administration policies.
