Letitia Silas was interviewed in the Fall 2020 edition of HR Magazine for a feature on how employers can address and resolve labor conflicts related to the current COVID-19 pandemic. The article explores the legal boundaries put forth by the NLRA and what employers need to know about protected concerted activity (PCA). Letitia advises employers to make sure managers and supervisors know hot to recognize PCA or indicators that certain types of activity might be PCA. If employers can take disciplinary action against non-PCA, she says that management’s response to unprotected behavior is key. Interrogating, threatening, imposing more-onerous working conditions or taking formal adverse action will stimulate a new round of complaints.
