Houston Attorney Reviews Supreme Court Decision on FAA Exemptions

In the Daily Journal article titled “Supreme Court: Arbitration Act exemption covers transportation workers,” Houston attorney Felix Digilov discusses the U.S. Supreme Court’s decision in Oliveira v. New Prime Inc. In the 8-0 decision issued Jan. 15, the Court ruled that a broad exemption for transportation workers in the law covers independent contractors and that application of the exemption must be decided by a court.

According to Felix, the Court’s reasoning could be applied widely, even though it only ruled on the exception applying to Oliveira. Felix added that he expects the phrase “interstate commerce” in the law will be litigated next.
