Alex Castro was quoted in a Bloomberg Law article about a new Florida law that would limit what employers can say to their employees in corporate training sessions related to race and gender issues. Lawmakers sent the bill to the governor on March 10.
The legislation includes safe-harbor language that protects employers and teachers who discuss any of the identified concepts in a neutral way without espousing them, said Alex.
“Employers are permitted to talk about these things as long as they’re doing so in an objective manner and they’re not adopting these views,” he added, suggesting that employers should review their training materials and discuss the changes to Florida law with their human resources staff who conduct training. “They need to stick to the script of the company’s training materials and avoid making offhand or tongue-in-cheek comments that could be viewed as espousing certain viewpoints.”
