FLSA Evolution Reflects Employer-Friendly Shift

In an article for Law360, Hollie Reiminger discusses the current state of wage and hour litigation across the country and explains that, for the first time in decades, we are seeing novel Fair Labor Standards Act (FLSA) interpretations gain some traction with the courts. The article describes that the current landscape has armed companies with more tools with which to push back against worker allegations of misclassification and unpaid overtime wages. While Hollie admits that it’s impossible to predict with any level of certainty what surprises lurk around the corner as employers head toward 2021, she is certain that the FLSA will continue to evolve and for now she believes that the wage and hour pendulum is slowly but surely being pushed back in the direction of companies.
