Fisher Phillips Partner Discusses PWFA Enforcement Efforts

In an interview with Bloomberg Law, Deniz Reilly shares her predictions around the U.S. Equal Employment Opportunity Commission’s (EEOC) enforcement of the Pregnant Workers Fairness Act (PWFA). Deniz explained that EEOC Chair Andrea Lucas has taken issue with the agency’s Biden-era PWFA extending to fertility treatment. Deniz added that she wouldn’t anticipate fertility treatments to be encompassed in any future definitions if there is a revision to the Act’s definitions under Lucas' leadership. Deniz further discussed the potential impact on the workplace if fertility treatment was removed from the PWFA’s current definition and recognized the substantially expanded accommodation requirements that now exist for employers with the current version of the PWFA, as compared to the ADA.
