Fisher Phillips Attorney Explains Bill Codifying ABC Worker Classification Test

In the article for the San Fernando Valley Business Journal titled “Bill Codifies Dynamex,” Los Angeles Partner Lonnie D. Giamela discusses California Assembly Bill 5 (AB 5), a bill that codifies the Dynamex ABC worker classification test into state law. AB 5 passed the state Assembly on May 29 and now advances to the Senate for review.

The bill was amended to include exemptions for certain workers, but Lonnie explains that the business community is seeking further exemptions. Lonnie also discusses another recent amendment that makes the bill retroactive to lawsuits dating back several years. If AB 5 is passed as currently written, Lonnie explains, a court would be able to use the ABC test “going backwards in addition to going forward in its analysis.”
