In a recent interview with SHRM regarding whether employers should permit employees to vape, Chicago attorney Jay Hux explained that some employers don't have explicit policies or haven't carefully considered how they want to treat vaping. "Other employers have added it on to a smoking policy," he said. According to Hux, employers may have the discretion to treat vaping as they want, but employers should consider state and local regulations when developing a workplace policy.
