Business Insurance on May 29 quoted Lawrence McGoldrick of the Atlanta office in the article "Employers Struggle to Control Wage-and-Hour Litigation." The article noted that the Department of Labor reported there were 40,000 wage-and-hour complaints during fiscal 2010, up about 15% from the roughly 35,000 complaints in fiscal 2009. Claims typically fall into two major categories: misclassification of workers as exempt, and unpaid overtime. Lawrence pointed out that the weak economy has played a role in rising litigation as laid-off workers go after their previous employers. "It's hard to be in full compliance, even for a good employer."
