Memphis Managing Partner Jeff Weintraub was quoted in the April 5 Memphis Business Journal article “Employers, States on Shaky Ground When it Comes to Same-Sex Marriage.” The article reviewed the ongoing debate over gay marriage and employers’ anxiety about how the upcoming Supreme Court ruling could affect them. Jeff said “there are a lot of states’ rights issues in question here.” He added that moving from one state to another could produce problems. “Where the real issues arise is if a same-sex couple gets legally married in New York and they move to Tennessee,” Jeff said. “Under the Tennessee constitution, even if another state issues a license for same-sex persons to marry, the marriage is still going to be void and unenforceable in Tennessee and Mississippi.”
