In an interview with MedPage Today, Michael Elkon shares his insights on the FTC’s proposed ban on non-competes and what it might mean for healthcare employers. Michael suggests that part of the motivation behind the rule stems from other sectors and businesses overstepping when it comes to non-compete clauses. He notes that some employers have employees who should never have been subject to them, such as lower-wage employees who are not developing relationships on behalf of a business and are not exposed to large amounts of confidential information.
He explains that in the healthcare sector, many employers would have to reevaluate their agreements with their physicians if this rule went into effect. Michael believes the FTC will be faced with legal challenges when it comes to the proposed rule.
