This week, the United States Department of Labor published the anxiously-awaited proposed changes in regulations defining the federal Fair Labor Standards Act's Section 13(a)(1) executive, administrative, professional, outside-sales, and derivative exemptions for public consideration and comment. Among other things, the DOL has proposed an increase to the minimum salary threshold for certain exempt employees by approximately 200%, to $921 per week, which annualizes to $47,892. Although the provisions are not yet in effect, now is the time to analyze how they might affect your Company and to determine what steps your Company needs to take to maintain its wage-hour compliance going forward.
