Lonnie Giamela weighed in on the case.
He said that employers in California, where many sharing economy companies are based, could have benefited more from the case if there had been an opportunity to get answers to the state’s tests for independent contractors. “Now they all still just run the same risks,” Lonnie said.
Whether a driver organization under these constraints can have any teeth is yet to be seen, noted Lonnie, who pointed out that without the drivers getting employee status, there isn’t much legal impetus for Uber to take the associations’ concerns seriously. “The question becomes, how meaningful will these associations be in the process?” he said.
