In an interview with SHRM, Risa Boerner discusses the pros and cons of monitoring remote workers. She explains that employers should be mindful of employee privacy rights, including those contained in specific monitoring laws as well as common law and even state constitutional rights to privacy in certain locations. She also cautions that employers monitoring employees may unintentionally capture personal information. “Employers should consider limiting the scope of monitoring and providing notice of the practice, even when it’s not expressly required by statute,” said Risa.
