The article “Coordinating Wellness Requirements Under ADA and GINA Cloudy” discussed how the Equal Employment Opportunity Commission’s (EEOC’s) April 20, 2015, proposed rule on wellness programs and the Americans with Disabilities Act (ADA) punts on one outstanding question for HR professionals: how to coordinate compliance between the ADA and the Genetic Information Nondiscrimination Act (GINA) on incentives for wellness programs.
“Because GINA prohibits a wellness program from offering an incentive for individuals to provide genetic information, including family medical history, this is an issue that will have to be addressed separately,” C.R. noted.
