Co-Chairs of Workplace Safety Practice Discuss Newly-Released Emergency Temporary Standard

In an interview with McClatchy, Todd Logsdon and Travis Vance discuss OSHA’s newly-released Emergency Temporary Standard (ETS) governing employer vaccine and testing requirements. Todd explains that the first 472 pages of the 490-page document lays out OSHA’s legal basis for adopting the ETS. Travis adds that a potential legal challenge to the rule could require OSHA to explain how a “grave danger” only affects workplaces with 100 or more employees. Travis also discusses that other potential challenges to the ETS might involve the “major questions doctrine” and the “delegation doctrine.”
