Cleveland Attorney Provides Insight On Diversity in Universities

Cleveland Partner Sarah Moore was quoted in the Insider Higher Ed article “Will Trump Change the Way Colleges Seek Diversity?” The Trump administration rescinded guidance from the Obama Administration on how colleges can legally consider race and ethnicity in admissions. Several educational institutions stated they would not be changing their recruitment and admission policies based on the administration’s actions, but some believe colleges will face legal challenges in the future.
Sarah believes colleges that base their policies on the guidance issued by the Obama administration should be able to survive legal challenges because they’re based on Supreme Court rulings.
Still, Sarah suggests colleges prepare for the challenges ahead. Sarah points out that the Justice Department should take the Supreme Court’s previous ruling into account when pursuing legal action, but acknowledges that “our colleges are in for a fight."
