During dangerous hurricane conditions, employees who don’t report to work can be fired under North Carolina policy. However, employers who fire workers for this reason could face violations under state and federal OSHA safety laws. In the Bloomberg Law article “Hurricane Safety Concerns May Get You Fired in North Carolina,” Travis Vance and David Klass explain that if “a state of emergency is declared, and citizens are asked not to drive on public roadways in certain areas, there is an argument that an employer who dismisses an employee for failing to come to work under these conditions may have violated North Carolina public policy.”
