In an interview with Bloomberg Law, Jeff Thurrell discusses trends in COVID-related litigation from workers who will want to continue to work from home post-pandemic. Though employers generally can deny accommodations that cause an “undue burden” to the business, denying work-from-home requests may be a hard sell considering how long many employees have been working remotely. Mental health claims add additional complexity. “Mental health issues go up and down, and become hard to manage,” Jeff says. “They continue to have a daunting task and could get overly frustrated by the unpredictability. Mental health issues are always the most challenging to wrestle with for employers.”
