In an interview with Law360, Joshua Nadreau discusses a recent ruling by the NLRB that lays the foundation for the agency’s majority to extend Weingarten rights to nonunion workers. In reference to the Board’s language in a recent ruling, Joshua explains that although it may suggest that Weingarten rights apply to nonunion workers, the context makes clear that the board was only opining on employers' obligation to strike replacements. He also notes that a decision extending Weingarten rights to nonunion workers would involve "major operational changes for employers to the extent workers know to seek representation in disciplinary meetings, though it may not ultimately be much of a restraint on discipline.”
