Boston Partner Discusses Proposed NLRB Rule

In an interview with SHRM, Joshua Nadreau discusses the National Labor Relations Board’s (NLRB’s) proposed rule to rescind a 2020 amendment to the "blocking charge" rule. If finalized, employees will have a more difficult time voting out unions that they no longer want to represent them. Joshua explains that under the 2020 amendment, some of the gamesmanship was eliminated. "This meant that employees cast their ballots when the issue of union representation or decertification was fresh in their minds, presumably leading to a more informed choice," Joshua said. The current NLRB proposal would scrap these safeguards, returning to the prior policy and allowing the strategic use of blocking charges once again, and potentially resulting in "a recipe for abuse and manipulation.”
