Bloomberg Law Turns to Fisher Phillips Partner on Why States are Preemptively Passing Legislation Banning Worker Microchipping

Risa Boerner, Chair of the firm’s Privacy and Cyber Group, spoke with Bloomberg Law on the emergence of legislation that bans employers from requiring their workers to have devices implanted into their bodies, such as microchips or RFID tags. Indiana, for example, is the latest state to sign into law these measures, but the act of requiring employees to be microchipped isn’t growing amongst employers in the U.S.
Risa told Bloomberg: “It causes you to question: Why is this being done? It’s not something employers are using widely, at least not yet. There’s certainly a lot of potential benefits to the technology in terms of convenience and security.”
