“There is such a fine line from compliance to overcompliance,” Kim Thompson of Fisher Phillips in Atlanta told Bloomberg BNA Dec. 16. The key is “knowing when to stop and what you can ask,” and the regulations should help clarify that, she said.
“You can still do it right and people are going to sue you,” according to Thompson, who heads the firm's global immigration practice group. In fact, the DOJ “at one point was being pretty aggressive in terms of soliciting people to actually complain” about this type of discrimination, she said.
