Attorney Reviews the 'Masterpiece Cakeshop’ Ruling

Andrew Hoag of the Los Angeles office authored The Recorder article “The 'Masterpiece Cakeshop' Ruling's Guidance to Employers.” In this article, Andrew provides an analysis on the U.S Supreme Court decision that ruled in favor of a baker who refused to make a cake for a same-sex couple.
“In large part, the Supreme Court’s decision avoided confronting the public accommodation and civil rights versus free speech and free exercise dichotomy. A resolution of this dichotomy could have had profound political, social and business implications,” he said. Until the Supreme Court confronts this issue, lower courts have little guidance on the matter. Andrew suggests employers remain cautious when creating policies regarding accommodation for both customers and employees.
