Partner Danielle Urban is quoted in The Wall Street Journal article “More U.S. Workers Test Positive for Certain Illicit Drugs.” According to data from Quest Diagnostics, there is an increased number of job applicants testing positive for illicit drugs, especially in states that recently legalized marijuana for medical or recreational use. Though marijuana is still an illicit drug at the federal level, it is legal in some form in 30 states and the District of Columbia.
Danielle notes that “even in states that have loosened or dropped restrictions on buying, selling and using marijuana, the legal status of the drug is unstable.” As the laws on marijuana continue to change, and qualified employees become scarce, employers are beginning to question whether to reject job applicants who have tested positive for marijuana.
